Ozempic lawsuit can move forward

(Ozempic Lawsuit) A Louisiana federal judge rejected on Friday Novo Nordisk's attempt to dismiss one of the first lawsuits on behalf of the company regarding the adverse consequences of its drug Ozempic.

December 12 (The Justice Now) – – U.S. District Judge James Cain Jr stated that plaintiff Jaclyn Bjorklund had offered enough evidence in her case to support her argument that Novo did not inform her doctors of the dangers of gastroparesis, which is a slowdown in the process of emptying large intestines into stomachs caused by the medication.

The judge rejected Bjorklund’s breach of warranty claim. She claimed that the company was promoting its product as safe, stating that she could not identify specific guarantees offered through Novo Nordisk. Cain denied the warranty claim with no prejudice, meaning Bjorklund may modify and resubmit her claim.

A spokesperson for Novo Nordisk, which has argued that the side effects Bjorklund sued over are well known and documented in the drug’s U.S. Food and Drug Administration-approved label, said the company “believes that the allegations in the lawsuit are without merit, and we intend to defend against these claims vigorously.”

It is also said that the company has also announced that its products have been thoroughly researched and are continuously monitored.

In her lawsuit, Bjorklund claimed she used Ozempic for over one year and then changed to Mounjaro on July 20, 2023. It is produced by Eli Lilly to treat Type 2 diabetes. Both drugs resulted in extreme vomiting and pain, which caused her to be admitted to the hospital. It also resulted in her losing her teeth.

The spokesperson of Eli Lilly said Bjorklund’s lawsuit was unfounded and that Eli Lilly’s company reviews, monitors, and provides safety information for all of its drugs. The company has made an additional request to dismiss. The motion is in the process, according to court records.

Since Bjorklund made her complaint in August, more than 20 additional lawsuits have been filed against Novo and Eli Lilly over the category of drugs known as GLP-1 receptor antagonists.

The lawsuits, brought on behalf of patients who were prescribed medications such as Ozempic, Mounjaro, and Wegovy to treat diabetic conditions or assist with weight loss, argue that the drug companies hid or failed to warn consumers about the possibility of adverse effects, such as abdominal paralysis, stomach obstruction or paralysis.

Lawyers from Morgan & Morgan, who represent Bjorklund, have contacted the U.S. Judicial Panel on Multidistrict Litigation to combine the lawsuits before Cain. The firm is looking into more than 10,000 allegations regarding the use of drugs.

One of Bjorklund’s attorneys, Josh Autry of Morgan & Morgan, in an announcement that the decision of Cain is a sign that he has shown “diligence and attention” to the case, which supports the argument that Bjorklund should be the head of any multidistrict litigation that is conceived for these cases.
