In principle, Johnson & Johnson has agreed to pay $700 million to settle claims from more than forty U.S. states that it did not correctly market its baby powder containing talc, Bloomberg News reported on Monday.
The settlement could ward off potential lawsuits claiming J&J concealed any connection between talc contained in its powder and various cancers, according to the report citing sources familiar with the agreement.
J&J and the state attorneys general representatives are working out the specifics of the agreement but have reached an agreement on the total sum, Bloomberg News reported.
J&J did not immediately reply to a Reuters request for comments.
Courts have rejected two attempts from the firm to use the bankruptcy procedure to restrict its liability to litigation involving talc.
In the past, J&J had set aside approximately $400 million to settle U.S. state consumer protection actions in its $8.9 billion plan to settle allegations that its Baby Powder and other talc-based products cause cancer.
Several states, including New Mexico and Mississippi, had initiated consumer protection measures against J&J before the company’s LTL Management’s bankruptcy filing of 2021, which prevented the investigations from progressing.
J&J has stated that its Talc products are safe and won’t cause cancer.
