Novo Nordisk opens a new tab and has reached a settlement with a medical spa and a weight loss clinic in Florida, which was accused of promoting counterfeit versions of the weight loss and diabetes medicines, the Danish drugmaker said on Friday.
Feb 13 (The Justice Now) – Federal judges approved the agreements. They prohibit the companies from using Novo’s trademarks for diabetes medications Ozempic and Rybelsus, as well as weight-management drug Wegovy, to market compounded medications that claim semaglutide as their active ingredient.
One of the contracts opened a new tabich with Cosmetic Laser Professionals Med Spa in Miami. The one that opened a new tab was associated with Nuvida Rx Weight Loss Clinic in Tallahassee. They’re among 12 defendants, including spa clinics, compounding pharmacies, and clinics; Novo has sued over similar claims. It was also the only one to agree.
Novo did not provide any other settlement terms. The lawyers representing the defendants could not immediately respond to inquiries for comment.
The lawsuits filed by the company accuse defendants of making use of its trademarks to market custom-made drugs or compounded drugs that use the same components as brand drugs. They are produced legally through licensed pharmacy chains in the United States when the drug’s branded version is unavailable.
Although only Wegovy is recognized as a weight loss drug, Ozempic and Rybelsus are frequently used off-label. Sometimes, they are completely fake versions of the medications that have been popping up since supply has fallen compared to the booming demand.
